Condos: what the by-laws may prohibit (animals, rental, signage)

A declaration of co-ownership may restrict how a unit is used — but not arbitrarily, and not in a discriminatory way. What is allowed depends on what is written and how it is applied.

Check before acting

A declaration of co-ownership may restrict how a unit is used — but not arbitrarily, and not in a discriminatory way. What is allowed depends on what is written and how it is applied.

The rule must be written, adopted and applied to everyone

A restriction must appear in the declaration of co-ownership or in a by-law adopted by the required majority. A board cannot invent a ban mid-year or apply it to one owner without a serious ground.
