Dangerous Neighbouring Tree in Quebec: Document, Notify and Prevent Damage
Act when a tree, branch or roots threaten your property without cutting the neighbour’s property yourself.
Move people away and call emergency services if the tree contacts wires, blocks a road or is about to fall. Never stand beneath it.
Document the hazard
Photograph the tree from your property, cracks, lean, branches, roots, damage and distances. Record dates, weather, witnesses and communications.
Notify the owner
Request inspection and correction in writing. Quebec states that a neighbour can be asked to fell or straighten a tree threatening to fall onto another property.
Do not cut without permission
Do not cut the neighbour’s branches, roots or tree yourself. After refusal, a formal notice and legal step may be required; also check municipal bylaws.
After damage
Secure the area, notify insurers and preserve useful debris, reports and expenses. Liability can depend on foreseeability and whether an unforeseeable event caused the fall.
