Conduct of a Quebec bailiff: request an investigation by the professional syndic

Verify the bailiff’s identity, keep served documents and reports, separate court challenges, fee disputes and professional conduct, then use the right remedy.

Priority

A conduct complaint does not suspend a seizure, service, court deadline or judgment enforcement. Check the applicable court remedy immediately.

Identify the act and deadline

Record the file number, court, date of service or seizure and stated deadline. Obtain prompt legal advice if a court remedy must be filed.

Verify the professional

Confirm the bailiff’s name and status in the directory. Separate the bailiff, firm, creditor and lawyer who issued instructions.

Classify the problem

An error in a judgment goes to court; a bill may use conciliation or arbitration; professional misconduct may support a syndic investigation request.

Document the complaint

Attach served documents, report, inventory, photos, videos, witnesses, invoice and correspondence. Describe words and actions chronologically and keep originals.
